VITIMOLOGY AND THE CULTURE OF RAPE IN BRAZIL

Abstract

This scientific article aims to analyze the theme of Victimology and Rape Culture, a relationship that comes from a patriarchal society, influencing society as a whole, especially with regard to the passive subject. This research becomes relevant to society because it is a social context that requires evolution from debate, especially for reaching a national perspective. In this way, this conduct that offends the victim’s bodily and mental health or integrity will be addressed. In view of this, the specific objective is to verify the relationship between the crime of rape and victimology, and through this connection, in a more restricted way, to understand the origin of the culture of rape in Brazil. Therefore, considering this scenario, this study is dedicated to unraveling why the rape victim is still characterized as a mitigating factor in the crime of rape in Brazil? This research, in addition to bringing clarifications in a positive way to society, becomes a matter of particular interest to researchers, as the choice of this topic arises through the idea of ​​opportunity for dissemination and demystification of ways to seek help and recognition of the situation they are in. living, taking into account the Brazilian legislation. The research offers an organization in a certain area, which in this case is concentrated in the area of ​​citizenship, in which it is inserted in the line of research on Constitutionalism and the realization of rights. The approach method that will be used will be the deductive, together with the historical and functionalist procedure method, and the bibliographic research technique.
